1. Service operator and acceptance
TenderGuard Cloud is operated by AI XPOWER ENGINEERING, a business registered in Malaysia. By subscribing, requesting conversion, uploading a file or using an output, you agree to these Terms of Service and the linked Privacy, Refund & Cancellation, and Support & Delivery policies.
2. Service description
The service converts supported BOQ PDF content into editable XLSX files and may provide source mapping, automated quality checks and optional human review. The service does not provide quantity surveying, engineering design, legal advice, contractual interpretation or tender-submission approval.
3. Supported files
Founder support is limited to password-free electrical and M&E BOQ PDFs up to 300 pages and 50 MB, unless we approve another limit in writing. We may reject corrupt, unreadable, highly ambiguous, handwritten, encrypted, prohibited or unsupported files.
4. Automatic output and Verified 1:1
Automatic output is provided for customer review and is not represented as perfect. A file may be labelled “Verified 1:1” only after the applicable content, structure, order, calculation, source-traceability and reviewer-clearance gates have been completed for the supported scope.
5. Customer responsibilities
- You must have the right and authority to upload and process each file.
- You must check all outputs before using them for pricing, procurement, contractual submissions or commercial decisions.
- You remain responsible for quantities, rates, calculations, design, scope and tender submission.
- You must not upload malware, unlawful content, personal data that is not needed, or files subject to restrictions that prevent processing.
6. Subscription, billing and taxes
Founder plans are billed monthly in United States dollars (USD) and renew automatically until cancelled. Prices, included pages, seats and retention periods are shown on the pricing page at the time of purchase. The customer is responsible for applicable taxes, bank charges and currency-conversion costs.
7. Usage limits
Processing and Verified page allowances reset at the start of each paid monthly billing cycle and do not roll over unless stated otherwise in writing. We may suspend processing that exceeds plan limits until additional capacity is purchased or the plan is upgraded.
8. Confidentiality and data processing
We process uploaded files only to provide, secure and improve the contracted service. Access is limited to authorised personnel and service providers who need it for processing, support, security or legal compliance. More details appear in the Privacy Policy.
9. Intellectual property
You retain ownership of the files and business data you supply. We retain ownership of the software, workflow, templates, models, validation logic, documentation and branding used to provide the service. We grant you a non-exclusive right to use delivered outputs for your internal business purposes.
10. Availability and changes
The Founder service may include scheduled maintenance, manual processing and invite-only capacity controls. We may improve or change non-material workflow details. Material price or plan changes apply prospectively and will be communicated before the next renewal where reasonably practicable.
11. Warranty boundary
Except for the specific correction commitment stated in the Refund & Cancellation Policy, the service and outputs are provided on an “as available” basis to the extent permitted by law. No guarantee is made that every file is supported, that every automatic output is error-free or that an output is fit for a particular tender decision.
12. Liability
To the extent permitted by applicable law, AI XPOWER ENGINEERING's aggregate liability arising from a claim relating to the service is limited to the fees paid by the customer for the affected subscription during the three months before the event giving rise to the claim. We are not liable for indirect, consequential or tender-loss damages caused by customer reliance without independent checking.
13. Suspension and termination
We may suspend or terminate access for non-payment, abuse, security risk, unlawful activity, repeated breach, or use that threatens other customers or the service. Customers may cancel in accordance with the Refund & Cancellation Policy.
14. Governing law
These terms are governed by the laws of Malaysia, without limiting any mandatory consumer rights that apply in the customer's country.
